How much bodily injury insurance is required in Pennsylvania?
Pennsylvania requires drivers to carry bodily injury liability insurance of $15,000 per person and $30,000 per accident. This type of coverage will pay for other drivers’ injury-related damages if the policyholder injures someone in an accident. Pennsylvania drivers also must carry medical benefits coverage, which pays for the policyholder’s own medical damages.
Collecting Damages from Your Own Medical Benefits Coverage
Pennsylvania is a no-fault state. This means that when you are involved in an accident, you will file a claim with your own insurance company, regardless of who was at fault for the accident. The state requires that drivers carry a minimum of $5,000 in medical benefits coverage, though some choose to purchase more coverage.
If you chose to purchase additional, optional coverage, you may rely on that as well. This might include loss coverage and collision coverage, which can help replace lost wages and repair your car.
What is an IME?
An IME stands for “independent medical examination”. It is called “independent” because it is supposed to be an impartial examination retarding your injury; however, it is rarely independent and rarely impartial. In reality, an IME is almost always requested by the insurance company and used as a basis to deny your claim or to low-ball a settlement offer.
If an insurance company requests an IME, you need a bodily injury attorney to make sure that the examination is done fairly and properly. Additionally, your bodily injury attorney can cross-examine the doctor about the examination to show any mistakes the doctor may have made.

What if your medical benefits coverage isn’t enough?
A serious injury can rack up tens of thousands of dollars in damages — or more in some cases. Many drivers’ medical benefits coverage just isn’t enough to take care of all the expenses.
In the event that you’re injured in an accident and your medical benefits coverage isn’t sufficient to cover your medical expenses, you may pursue a tort claim against the at-fault driver. But your ability to do so is dependent on the type of insurance you purchased and the extent of your injuries.
If you chose limited tort, then you may only file a tort claim against the other driver for pain and suffering if you suffer serious injuries. You may recover out-of-pocket medical expenses if you have limited tort coverage, even if your injuries are not serious. If you have full tort coverage, you are not limited in your right to pursue pain and suffering damages from the at-fault driver.
A bodily injury attorney in Pennsylvania can review your insurance policy with you to let you know what coverage is available and whether you can sue for your injuries.
